(a) The contractor shall ensure that any excess of outstanding advances in excess of the contractual limit set out in subparagraph (a) of the advance payment clause of the contract is promptly corrected by one or more of the following measures: (c) Under the terms of the agreement, the contractor should provide for priority privilege in favour of the Government. (4) Name and address of the financial institution with which the contractor intends to establish a special account as depositary of advance payments. If advance payments in the form of a letter of credit are anticipated, the entrepreneur must specify the specific account with the financial institution to be used. Point (b)(4) of this point shall not apply where another method is used in the Agency`s procedures. (d) If ownership of materials or other supplies is transferred to the Government pursuant to the progress payment clause, the Contractor may transfer the items in stock under the Contract for its own use or other disposition only if and on terms approved by the Customer.
